The ninth circuit court has upheld a ban on sending national guard in the Oregon city, after a latest legal decision.

Judicial Panel Concurs to Reconsider Case

The ninth circuit court of appeals ruled on this week that it would rehear the case concerning the executive power with an expanded group of eleven justices. The judicial body also overturned a earlier decision from a smaller judicial group that had sided with the administration.

Legal Saga Over Troop Deployment

This legal directive represents the most recent turn in a long-running legal battle over whether the administration has the authority and valid reason to send national guard forces in Portland. Approximately two hundred troops have been in uncertainty since the end of September when the mobilization attempt was started in due to ongoing demonstrations.

Conflicting Arguments

The administration has claimed that federal officials at the immigration center in the southern part of the city were facing threats, while local authorities assert that local officers have control of the situation.

Contrary to descriptions of the city as a conflict zone, locals have been posting footage of scenic paths and a thriving food scene, and planning activities such as an Emergency Naked Bike Ride against the “militarization of our city”.

Recent Legal Actions

The Tuesday ruling came after a federal judge in the city issued two legal injunctions this period – one blocking the federalization of the Oregon national guard, and another prohibiting the deployment of any national guard troops in Oregon, after attempts to evade the first order by mobilizing out-of-state forces.

On the previous day, the ninth circuit panel had temporarily suspended the initial decision – allowing command of 200 Oregon national guard – but the subsequent injunction remained in place, preventing the actual deployment of the troops.

En Banc Review

The Tuesday decision means the matter will be heard “en banc” – with both rulings under consideration simultaneously – by a group of eleven justices.

“This decision shows that facts are important and that the judicial system are working to ensure government responsibility. The constitution limits the executive authority, and local populations cannot be treated as a testing site for unchecked federal authority,” stated the legal representative in a statement.

“The judicial body is sending a definite signal: the president cannot send the armed forces into US cities without cause. We will continue defending state legislation, values, and autonomy as this legal proceeding moves forward and our fight continues in the courts.”
